In case you missed this week's The View From The Top, here is the Immigration update for the week of October 12, 2022 from Fragomen's Julia Onslow Cole.
In this show Julia discussed more creative solutions to immigration challenges.
EB5 Visa
In the U.S. it can be difficult to get a green card — there is a lot of information including salary that is required, all all of which is available in the public domain. Many companies do not wish to have this information publicly available, but there aren't many other options.
However, one alternative is an EB5 Visa that allows for self-sponsorship. Under this program, investors (and their spouses and unmarried children under 21) are eligible to apply for a Green Card (permanent residence) if they:
-
Make the necessary investment ($800,000) in a commercial enterprise in the United States; and
-
Plan to create or preserve 10 permanent full-time jobs for qualified U.S. workers.
This program is known as EB-5 for the name of the employment-based fifth preference visa that participants receive.
O1 Visa
Another option is to use the O1 visa — this visa is intended for individuals with extraordinary ability or achievement.
Economic Citizenship
Another possibility for executives who travel frequently, and need visas for many countries is Economic Citizenship — this can be a cost-effective option for some countries who provide visa-free travel schemes.
